Work Permit Policy

 

It is against Federal and State Labor Law for a minor (anyone under the age of 18) to work any time during the year (including vacations and holidays) without a work permit.  A work permit will be revoked whenever the Guidance Office or ES determines the employment is illegal or is impairing the health or education of the minor. 

 

School policy states that when school is in session:

 

EXCEPTION:

16-17 YEAR OLD STUDENTS MAY WORK MORE THAN 32 HOURS PER WEEK (NOT TO EXCEED 4 HOURS PER DAY Monday through Thursday and not to exceed 8 hours on Friday, Saturday, or Sunday.  Not to exceed 38 hours per week) with written approval from the Parent, Guidance Counselor and the student’s ES.  Work permit hours will be reduced if the ES and/or parent decide that the student does not meet his/her educational goals and objectives.  ES will be contacted by the office to obtain your approval prior to issuing the work permit.

Any Student needing an “Entertainment Industry Work Permit” must contact the California Department of Industrial Relations.

 

SCHOOL POLICY STATES THAT WHEN SCHOOL IS NOT IN SESSION (vacations and holidays):

       · 16-17 year old students may work a maximum of 48 hours per week, not to exceed 8 hours per day.

        14-15 year old students may work a· maximum of 40 hours per week, not to exceed 8 hours per day.

        12-13 year old students may work a· maximum of 40 hours per week, not to exceed 8 hours per day.

It is the student’s responsibility to complete and send to the Guidance Office a new “Request for Work Permit” form prior to the expiration date of the current work permit.  A new “Request for Work Permit” form must always be completed when the previous work permit has expired.  In the event that a student continues to work with an expired work permit he/she and the employer is in direct violation of state and federal labor low and may be subject to substantial penalty and fines.

 

On the day of a student’s 18th Birthday a Work Permit is no longer required!

 

The work permit expires automatically when you leave, quit or are fired from a job.  You must request a new work permit each time you obtain a new job.

 

Work Permit Packets for holiday and summer work must be post marked and/or received by the Guidance Office no later than 2 weeks before the last day of school before the 1st day of vacation; otherwise, the work permit must be obtained from the nearest local public high school.

A completed Work Permit Packet must include the following or it will be sent back to you:

 

1.      Attach and include a copy of your Social Security Card.

To apply for or replace your Social Security Card on-line, log onto http://www.ssa.gov/replace_sscard.html.

2.      Attach and include an official copy of your Birth certificate – Evidence of

Minor’s Age.  VitalCheck is a service that accesses agencies that will issue certified copies of birth records for a fee.  To order a Birth Certificate on-line, log onto http://www.vitacheck.com/.

3.      Complete and sign the “Statement of Intent to Employ Minor and Request for Work Permit” form.
